<title>New Jersey Rings in Winter ...and a Spate of Accidents</title>
<description><![CDATA[<p>New Jersey welcomed the onset of winter with ferocious weather that was linked to several <a href="http://www.grossmanjustice.com/lawyer-attorney-1236317.html"><strong>car crashes</strong></a> and&nbsp; <a href="http://www.grossmanjustice.com/lawyer-attorney-1240027.html"><strong>truck accidents</strong></a>, as well as a plane crash near Linden.</p>
<p>The morning of the 21<sup>st</sup> saw a multi vehicle accident on the New Jersey Turnpike that left at least 17 people with injuries, none of which fortunately, were serious ones.&nbsp;The crash involved at least two buses, and a total of 90 passengers.&nbsp;Across northern New Jersey, dozens of <a href="http://www.nj.com/news/ledger/topstories/index.ssf/2008/12/winter_storms_into_new_jersey.html"><strong>other accidents</strong></a> were reported, all as a result of the blizzards that rushed in over the weekend.&nbsp;In another weather-related crash that could have turned into a disaster, four police troopers had a narrow escape when a tractor trailer smashed into an accident scene they were at on Interstate 80 in Hope.&nbsp;The officers were responding to the scene of a crash involving a spin out.&nbsp;A tractor trailer approaching the scene lost control, and skidded into another vehicle before slamming into the fire truck that was stopped nearby. The truck protected the troopers from taking the direct impact of the tractor trailer.&nbsp;</p>]]><![CDATA[<p>It was not just on the ground that the effects of the weather were being felt. A Hampton couple whose <a href="http://www.newsday.com/news/local/wire/newjersey/ny-bc-nj--planecrash1222dec22,0,4262367.story"><strong>small engine plane crashed</strong> </a>in Linden was being treated at a hospital for injuries.&nbsp;The plane was being piloted by Jason Snyder, and his wife Jennifer was the only passenger.&nbsp;The couple had apparently stalled their plans for flying out of the state over the weekend because of the weather, and had taken off from Linden airport on Sunday evening after the weather had cleared a bit.&nbsp;The plane first crashed into a few trees, and then went down in an industrial area near Linden.&nbsp;&nbsp; Both husband and wife managed to crawl out of the wreckage before the plane burst into flames.&nbsp;They were conscious, but seriously injured when help arrived a while later.&nbsp;&nbsp;&nbsp; Some reports say that the pilot had reported some mechanical failures with the plane just before it crashed, but it will take a while before all investigations are complete.</p>
<p>The holiday season is often an extra busy time for state traffic enforcement officers, and this time it looks as though the holiday accidents statistics will be made worse by the poor weather.&nbsp;As thousands of people begin driving cross state to meet up with family, driving experts are warning motorists not to that assume they are protected by their car and can afford to drive in their usual manner.&nbsp;Consider this - most deaths that occur due to a winter storm are not due to hypothermia, but weather related accidents!</p>
<p>Here are some <a href="http://www.state.nj.us/emergency/general/driving.pdf"><strong>tips on driving safely in wintry weather</strong></a>:</p>
<ul type="disc" style="margin-top: 0in;">
    <li>Have a mechanic check the battery, anti freeze, ignition systems, thermostat, and brakes in a complete check up of your car before you venture out.</li>
    <li>Install good winter tires.&nbsp;</li>
    <li>Keep a significant distance between your car and the one in front of you.</li>
    <li>Keep your cars stacked with food, a first aid kit, blankets, newspapers for insulation, and bottled water. Have a piece of colored cloth in the car &ndash; it can serve as a flag if you are caught inside your car in the middle of a blizzard.</li>
    <li>Keep your radio turned on for weather warnings, and reschedule your plans if possible.</li>
    <li>If you can, stick to public transport during the holidays.</li>
</ul>
<p>Heed all warnings, drive extra cautiously, and stay safe this season!</p>

<title>New FMCSA Rule Could Mean More Truck Accidents</title>
<description><![CDATA[<p>The Bush administration has <a href="http://www.propublica.org/article/another-midnight-reg-keep-truckin-for-longer-hours-1212"><strong>finalized</strong></a> an <a href="http://www.fmcsa.dot.gov/"><strong>FMCSA</strong></a> drafted rule that upholds the same number of hours a truck driver can work as previous regulations, but truck safety advocates say it will do nothing to stop the number of <a href="http://www.grossmanjustice.com/lawyer-attorney-1240027.html"><strong>truck accidents</strong></a> in the country.&nbsp;The rule will limit the number of consecutive hours a truck driver can work to 14, and stipulates that 11 hours of these be spent behind the wheel.&nbsp;The administration says reverting to the old rules that limited the number of work hours that truckers could drive to 10 daily were not feasible, as they were contributing to a yearly loss of $2.4 billion for the trucking industry.</p>
<p>As the administration tries to push through these regulations in a mad rush before it vacates office, truck safety groups and trucker groups continue to worry that these long hours on the job are not good for truckers nor for highway safety.&nbsp;The administration claims that studies have proved that accident rates have declined since the longer work hour rule was introduced.&nbsp;&nbsp;&nbsp;&nbsp;</p>]]><![CDATA[<p>Most of the studies that the administration is relying on have been funded by the government, and there is also very little inclusion of other factors that cause accidents, like the general health of the driver, driver fatigue, any non driving work that truck drivers indulge in, as well as the role of pay in truck driver morale, and consequently, safety.&nbsp;Besides, there are studies that show that a disturbing number of truck drivers are likely to lie on the log books, and work more than the stipulated 14 hours.&nbsp;Long haul truckers who've been in the business for a while claim that log book manipulation has been around for a while, and it's not uncommon to have a truck driver work for close to 80 hours per week.</p>
<p>Meanwhile, concerned citizens are joining in concerted efforts to fight the administration's rule.&nbsp;</p>
<p>Although the number of truck accidents has declined, there are still far too many truck accident related fatalities on our highways, compared to passenger car and other traffic accident related fatalities. Any rule that hopes for a change in this situation must take into consideration the unique duties and responsibilities of truck drivers &ndash; long hours staring at the road ahead without a break, time away from family, lack of sleep, rest, and timely meal breaks. All these affect a truck driver's capacity, and must form the basis of a long term policy on trucking work hours, hopefully by the new administration. Any losses to the trucking industry must not be an excuse for putting truck drivers' health, and the lives and safety of countless motorists on the streets, at risk.</p>

<title>The Number of Traffic Fatalities in New Jersey Are Down</title>
<description><![CDATA[<p>New Jersey traffic accident related fatalities have statistically decreased by 17 percent over the past 12 months however, the actual number of deaths remains at an unacceptable horrifying 207 between January 1st and May 17 of this year. These statistics were reported in a recent <a href="http://www.nj.com/sunbeam/stories/index.ssf?/base/news-3/121161722114510.xml&amp;coll=9">Today&rsquo;s Sunbeam</a> article that interviewed New Jersey State Police Colonel Rick Fuentes. Fuentes stated&hellip;&ldquo; As alcohol related crashes make up a large percentage of fatalities, the focus of our communities must be first devoted to both deterrence of drinking and driving and secondly to the enforcement of DWI related offenses.&nbsp;</p>
<p>State Police Deputy Superintendent of Operations Juan Mattos said, &quot;Four of the seven fatal motor vehicle accidents on Memorial Day 2007 were alcohol related. This is a pointless waste of lives we will attempt to avoid by relentlessly pursuing intoxicated drivers.&quot; Superintendent Fuentes added &quot;We can only do so much to encourage safe behavior. In the end, New Jersey's drivers must decide to act responsibly.&quot; </p>

<description><![CDATA[<p>The results are in! <a href="http://www.aaamidatlantic.com/safety/release_content.asp?id=4128">The AAA Clubs of New Jersey</a> biannual transportation survey published the results which revealed that the top five safety issues on our roads are:</p>

<title>Injured while riding on a motorcycle, in a bus, taxi or commercial vehicle in a New Jersey accident? Believe it or not, neither your truck, motorcycle or auto insurance company will be responsible for your medical bills.</title>
<description><![CDATA[<p>In New Jersey, as a general rule if you&nbsp;are injured while occupying or&nbsp;driving a motorcycle, moped, commercial vehicle, taxi cab,&nbsp;chauffeured rentals or bus&nbsp;you will not be able to seek PIP no-fault benefits for payment of your medical bills.&nbsp;That's right, if you have&nbsp;private health insurance your medical bills may be covered as long as&nbsp;your policy does not contain any&nbsp;specific exclusions for&nbsp;treatment you receive as a result of&nbsp;an accident&nbsp;while driving for example a motorcycle.&nbsp;&nbsp;</p>
<p>&nbsp;</p>]]><![CDATA[<p>While it appears counter intuitive, in New Jersey the&nbsp;individual <u>at fault</u> driver's insurance company in a motor vehicle accident is&nbsp;<u>not </u>responsible to pay for the injured's medical bills related to treatment for injuries sustained in the&nbsp;motor vehicle accident.&nbsp;&nbsp;Instead, it is&nbsp;the injured person's own auto insurance, their resident relatives auto insurance&nbsp;or&nbsp;the&nbsp;owner of the vehicle's&nbsp;insurance company that would be responsible to pay for the medical bills through&nbsp;the PIP, personal injury protection benefits portion&nbsp;of the respective policy.&nbsp; Unfortunately,&nbsp;this rule changes if you are injured in the above types of vehicles,&nbsp;since they&nbsp;have been deemed to have not&nbsp; met the &quot;automobile&quot; requirement of the PIP No-fault type medical expense benefits and therefore you will usually be excluded from coverage.&nbsp;&nbsp;</p>
