New Device Promises to Help Spinal Cord Injury Patients

As a car accident lawyer in New Jersey, I am pleased with some dramatic new advancements in the field of spinal cord injury treatment. Clinical trials into a new robotic exoskeleton that could help patients with these injuries to walk again, are on at a research center in Philadelphia.

The device has been developed by an Israel-based company, and comprises of a harness, backpack and leg supports. The equipment also includes sensors that can detect and communicate to a computer in the backpack that a step needs to be taken. The person can then walk using his crutches. The device works with the help of a battery that can be charged for three hours of use. However, in order to be able to use the device, a person must have the use of his upper body.

It is hard to overstate the kind of benefits that this exoskeleton can offer to patients with spinal injury who are unable to walk. As a New Jersey car accident lawyer, I often come across victims of serious auto accidents, who have suffered a spinal cord injury. I know the kind of hardship these people face as they begin to navigate life without the use of their lower limbs. These injuries can often been seen in major, high-impact car accidents, tractor trailer accidents, or as a result of accidents in the workplace. A serious fall can also cause a spinal cord injury.

If all goes well, the device could be available as quickly as a few months from now. Once the clinical trials end, the company Argo Medical Technologies, plans to apply to the Food and Drug Administration for approval. If the device is approved, the device will available in New Jersey and nationwide by late 2010.

Stem Cell Research Into Spinal Cord Injury Treatment Set to Begin

A long awaited breakthrough in the treatment of spinal cord injuries may be realized this summer as an American company announced its plans to begin the world's first study of stem cell treatment for spinal cord injuries.

The US Food and Drug Administration has approved a study by biotech company, Geron Corporation of California. The study will involve injecting eight to ten patients with stem cells or cells that are extracted from embryonic cells. The subjects will all be paraplegics, and the study will involve administering a single injection just two weeks after they have suffered a spinal cord injury.

The announcement coincides with the swearing in of President Obama, but insiders say that's just a coincidence. Obama had pledged to reverse Bush's standing on stem cell research during his campaign. Stem cell research has not been as much a part of this particular campaign, bogged down as it was by lipsticks, pigs and plumbers, but it was a significant campaign issue during the 2004 election. There's no doubt that medical researchers and the community at large have high hopes pinned on this new trial.

Spinal cord injuries can involve loss of mobility of various levels, each resulting in their own set of limitations. Paraplegics – whom the study will use as subjects - can move their arms, but not their body, while quadriplegia involves the loss of control over muscles, leading to an inability to walk, talk, or move other muscles. A complete cure has been elusive.

The way embryonic cells can treat major illnesses is by replacing damaged cell tissue, thus making them attractive in the treatment of a large number of conditions. The possibilities, medical researchers say are endless. Controversy has developed around the fact that embryos have to be destroyed in order to harvest the cells. Results of studies conducted on animals have been very encouraging thus far, but researchers involved in the project are urging caution. Obviously nobody is expecting miraculous overnight breakthroughs that can have a man out of his wheelchair in a day, but if successful, the possibilities for the therapy are endless. If you or a loved one has been a victim of a spinal cord injury as the result of an individual or a companies fault you should consutl with spinal cord injury lawyers as soon as possible in order to best preserve and protect your rights.

Why Winter Means More Spinal Cord and Traumatic Brain Injuries

As a Monmouth County personal injury lawyer, I constantly meet people with debilitating traumatic brain injuries and spinal cord injuries, but as this report shows, these are not always caused by workplace related accidents or automobile accidents. It's the season for sledding, skiing and skating, and also the time for some extremely serious and life altering injuries, if you're not careful out there.

The American Association of Neurological Surgeons estimates that every year, these winter sports injuries send thousands of men, women and children to emergency rooms around the country.

According to the CPSC's National Electronic Injury Surveillance System, there were more than 6600 head injuries caused during snowboarding, 5700 caused during sledding, 5400 injuries caused during ice hockey and 3700 caused by skiing. A total of more than 1200 head injuries were caused by snowmobiles, toboggans, and snow tubing. Many of these head injuries were caused because the person wasn’t wearing a safety helmet, or because the helmet wasn’t sturdy enough to take the massive impact of a fall or collision. In any case, head injuries at their mildest can cause concussion, or disorientation, and at their most severe, can result in traumatic brain injuries with possibly long term effects.

When it came to neck injuries on the ice, skiing was the number one risk with 1385 injuries occurring while navigating the slopes. Next was snowboarding with more than 1900 neck injuries, and hockey with more than 600 injuries. The rest of the injuries were caused by snowmobiles, sleds, skating and snow tubing. Most of these injuries are caused because of falls while playing, or colliding against another player or against a hard concrete surface. Spinal cord injuries can have debilitating consequences, at their very worst leaving patients in a quadriplegic state.

Although speed and the accompanying adrenalin rush is a big part of the winter sports experience, it's entirely possible for you to have safe fun on the slopes and ice. The ASTM has a few precautions for safe sports this winter. Always wear helmets that have the ASTM stamp of approval, and wear protective body clothing that’s appropriate to the sport. Avoid getting too adventurous, and follow all posted signs carefully. Look for any warnings of dangerous curves or posts ahead.

Danger can lurk in the most unexpected places whether you're circling a rink, or racing down the slopes. So, take all precautions, and practice safe sports this winter!

Motorcycle Accident Results In Traumatic Injuries

Motorcycle accidents and related fatalities and traumatic injuries is a serous problem in both New Jersey and our neighboring states. A recent article from The Express-Times reports a 27 year old was recently riding his motorcycle south on Route 611 about 2 a.m. when he veered into the northbound lane and crashed into a curb apparently suffering serious injuries. The police do not know what caused the rider to crash into the curb and the crash is under investigation.

As Monmouth County and New Jersey motorcycle accident attorney I have witnessed first hand the devastating life altering effects of motorcycle crashes. In this particular situation there could be many factors that made the rider swerve into the opposite lane leading him to strike the curb. What ever the cause of the accident may be, drivers on the road have to make sure they are careful around motorcycle riders. A simple act of having your high beams on can blind a driver and when the driver is a motorcycle rider they can more easily lose control and crash. One way to simply lower the motorcycle fatalities is to always keep a safe distance between your vehicle and the motorcycle and always proceed with caution before entering into a turn or a lane change. Motor vehicle drivers can do their part by being more responsible on the road and hopefully motorcycle riders will do their part by taking the right safety precautions.

Alcohol Related New Jersey Car Accident Leaves Grocery Shoppers Injured

We all know that drinking and driving often results in death, serious injury or the destruction of life. A recent local news story reported an accident in South Jersey recently sent several innocent grocery shoppers to the hospital. A car spun out of control and slammed into 3 people - two of them were in wheelchairs. The police are saying the driver was intoxicated when she crashed into pedestrians on a Shoprite sidewalk in front of the store.

As a Monmouth County and New Jersey car accident attorney I have represented hundreds of victims that suffered critical injuries because of alcohol related car accidents. This news story above highlights a all too common scenario whereby alcohol appears to have impaired this driver’s sense of judgment. The alleged intoxicated driver may have destroyed the lives of these innocent grocery shoppers who never would have imagined that they would fall victim to a drunk driver while going through their normal every day routine of pushing their grocery carts at their local supermarket. Drinking and driving frequently leads to victim's extreme suffering. I have witnessed first hand clients that have suffered at the hands of drunk drivers’ : traumatic brain injury, loss of limbs, spinal cord injuries including paralysis fractures, herniated disc injuries leading to spinal fusion or inter-body fusion surgery and a myriad of other life altering injuries and even death. So as a seasoned New Jersey and Monmouth County accident attorney lawyer I can attest unequivocally that alcohol mixed with driving of motor vehicles, motorcycles or trucks many times equates with the total destruction of innocent life and also destroys both individuals and their families. We can significantly reduce the number of serious injuries and fatalities in New Jersey by never ever driving while intoxicated or in any way impaired.

Cialis Found to Help Treat ED in Men with Spinal Cord Injuries

I read this article on MSN Health recently, announcing some promising news for men who suffer from erectile dysfunction (ED) resulting from from spinal cord injuries. A French study of about 200 male spinal cord injury patients revealed that the ED drug Cialis significantly helped treat the patients' ED. The study noted that only one-fourth of male spinal cord injury patients are able to have erections that are adequate for intercourse.

After the 12-week treatment period during the study, researchers found that the patients who took Cialis were 75.4 percent successful when attempting penetration and 47.6 percent successful when attempting intercourse, compared with 41.1 percent and 16.8 percent, respectively, for the men in the study who took the placebo.

Injured while riding on a motorcycle, in a bus, taxi or commercial vehicle in a New Jersey accident? Believe it or not, neither your truck, motorcycle or auto insurance company will be responsible for your medical bills.

In New Jersey, as a general rule if you are injured while occupying or driving a motorcycle, moped, commercial vehicle, taxi cab, chauffeured rentals or bus you will not be able to seek PIP no-fault benefits for payment of your medical bills. That's right, if you have private health insurance your medical bills may be covered as long as your policy does not contain any specific exclusions for treatment you receive as a result of an accident while driving for example a motorcycle.

While it appears counter intuitive, in New Jersey the individual at fault driver's insurance company in a motor vehicle accident is not responsible to pay for the injured's medical bills related to treatment for injuries sustained in the motor vehicle accident. Instead, it is the injured person's own auto insurance, their resident relatives auto insurance or the owner of the vehicle's insurance company that would be responsible to pay for the medical bills through the PIP, personal injury protection benefits portion of the respective policy. Unfortunately, this rule changes if you are injured in the above types of vehicles, since they have been deemed to have not met the "automobile" requirement of the PIP No-fault type medical expense benefits and therefore you will usually be excluded from coverage.

THAT'S RIGHT if you are injured while on a motorcycle or in a cab ride or on a bus or in a commercial vehicle, your medical bills will not be paid by available insurance. Thus, it becomes even more important to make sure that you retain a personal injury attorney who is proficient in New Jersey motorcycle accident law, truck accident law or taxi related motor vehicle injury law. This is because your attorney will seek compensation for your pain and suffering and for your outstanding medical bills from the at fault driver. This area of law has become very complex and requires counsel that has extensive experience in representing persons injured in truck accidents, motorcycle accidents, taxi cab accidents and bus accidents. This is particularly true in the case of victims of serious injuries because their mounting current and future medical debts with traumatic brain injury (TBI) or spinal cord injuries (SCI) could leave a family into life altering financial ruins.

My clients are often times totally shocked when I explain to them the realty of the PIP laws in New Jersey. They often ask how is this possible that I was riding in a taxi and the driver was in a major accident and his insurance company is not responsible for payment of my injury related medical bills? I tell them to thank the powerful insurance lobby who has done an amazing job blaming the "trial lawyers" like myself for your exorbitant insurance rates while netting BILLIONS in record profits and shielding themselves by succeeding in having the New Jersey legislature pass laws exempting them from payment to their insured's or insured's immediate family member's medical providers where medical claims have become exempt from coverage.

Representing clients throughout New Jersey including but not limited to Manalapan, Marlboro, Holmdel, Freehold, Millstone, Colts Neck, Howell, Old Bridge, Jackson, Red Bank, Hackensack, Saddle Brook, Paramus, Ridgewood, Teaneck, Demarest, Dumont, Pompton Plains, Glen Rock & Fairlawn the Law Offices of Scott D.
Auto insurance companies adopt "Delay, Deny, Defend" to maximize profits at consumers expense

"Delay, deny, defend" is the battle cry for the auto insurance industry to protect their multi-billion dollar empire. In a recent report filed by CNN's Drew Griffin, he uncovered that this practice is rampant among the nation's auto insurance companies when people are injured in what insurance representatives consider a "minor impact" auto accident. New Jersey attorneys representing persons who have suffered injuries in auto accidents have long experienced first hand these tactics of the nation's largest insurance companies. Throughout the past decade I have represented many individuals that were involved in what the insurance company deemed a "minor impact" and as a result of the accident they suffered serious permanent injuries such as a herniated disc. Many times the injuries were so debilitating that after multiple steroid injections, extensive narcotics usage, physical therapy and chiropractic care, spinal surgery became the only option. The suffering was very real.

The auto insurance companies do not want the public to understand the most important of Newton's Laws on Physics. Energy does not dissapear, it is transmitted to the impacted vehicle and hence to the occupants. Often times at trial, after years of delays from the insurance company, defense counsel will blow up a photo of the impacted vehicle that does not show significant property damage. A strategy frequently successful in having jurors draw an inference that the injuries claimed by the plaintiff are either untrue or if true they must have been from some other cause unrelated to the auto accident. The CNN news story referenced above did an excellent job exposing the tip of the iceberg when it comes to insurance companies doing whatever it takes to put corporate profits above the interests of those very individuals they are supposed to help.

In New Jersey when you are involved in a motor vehicle accident, your medical bills are supposed to paid for through the PIP, Personal Injury Protection benefits of the injured persons' insurance company without regard to who caused the accident. So in New Jersey, the medical benefits through PIP coverage follows the person and not the vehicle. However, the policy of denial often times happens through the issuance of a medical treatment cut-off or denial letter on the basis that the patient has reached MMI or maximum medical improvement. This frequently occurs without consulting the treating physician or without even examining the patient. Often the denial will be on the reccomendation of a physician advisor review. This means that a physician of like specialty will review some of your medical records and decide for your insurance company, while being paid by that insurance company if you should be cut-of from further treatment regardless of what you may be feeling. The system is driven to maximize profits by minimizing costs of medical care to insurance companies own insureds. To add insult to injury, these corporate profits aren't even passed onto the consumer in the form of auto insurance rate reductions. The PR spin shall continue........Blame the lawyers for your exorbitant auto insurance rates. It works each year after year along with the deeply ingrained favorite phrase of the insurance corporate elite ..."TORT REFORM".

SCI-Spinal Cord Injury

Over 10,000 people in the US suffer a spinal cord injury, also called SCI, each year. SCI is defined as any damage to the spinal cord that results in loss of function or mobility. Such injuries can be caused by trauma or disease and can result in temporary or permanent loss of sensation, loss of movement (paralysis), or loss of bowel or bladder control. Auto accidents are the primary cause but violence related accidents have been increasing steadily as a cause of SCI’s. Falls and sports accidents also cause many SCI’s each year.

There are two types of injury, complete and incomplete. A complete injury is one in which the victim has no sensation or voluntary motor movement on either side of the body below the level of the injury. If the victim has some feeling or partial movement, it is called an incomplete injury.

Injuries are usually defined with reference to the area of the spine affected. Nerves in the spine are defined by the area of the vertebrae – an injury to the spine in the neck area will affect the cervical vertebrae – injury to the nerves at the fifth cervical vertebra is called a C-5 injury, for instance. Below the neck are the thoracic vertebrae, so injuries there are defined as T-1, etc. Then there are lumbar and sacral vertebrae.

Generally speaking, neck injuries will lead to paralysis of all limbs (quadriplegia) while thoracic injuries cause paralysis to the lower limbs only (paraplegia). Both areas have variations in the amount of dysfunction, depending on the severity of the injury. An incomplete cervical injury can leave the patient with some hand use, while a complete injury at C-4 can require the patient to be on a ventilator. Thoracic injuries can leave the arms functional but interfere with walking, bowel and bladder control, and sexual function. Other functions that can be affected are blood pressure, body temperature, and pain levels.

A spinal cord injury usually involves swelling of the spinal cord which affects the whole body. When the swelling goes down, the patient may regain function months or years after the injury but it is rare for all functioning to be recovered. Treatment presently consists of stabilizing any broken vertebrae, maintaining the patient, preventing movement to the injured area, and reducing swelling. There is no cure for SCI but stem cell research has shown some signs of being useful in the future.

Motor Vehicle Accidents-Leading Cause of Injury in Young People

Every year millions of people are injured in motor vehicle accidents. Motor vehicle accidents are the leading cause of injury in the United States for people ages 1-34.

Many vehicle manufacturers have made safety improvements to their vehicles including air bags, rollover bars, reinforced frames, better tires, etc. Additionally, many states have passed tougher drunk driving laws. As a result, many lives may have been spared. However, with an ever increasing number of vehicles on the road, motor vehicle accidents still occur with alarming frequency. In fact, according to the National Highway Traffic Safety Administration, every 10 seconds someone in the United States is involved in a car accident.

If you have a young driver in your family, or a young person preparing to obtain his or her first driver's license, take a few moments with your child to obtain some really useful information from the New Jersey Motor Vehicle Commission.
